The Japanese drug maker has announced that its patent for Viagra, the brand name for the drug sildenafil citrate, expires this year. Sildenafil will now be available by prescription only to men of Japanese origin, but men who do not have the original drug can still obtain it by prescription.
Japan's largest drug maker, which makes more than a fifth of the country's $1.1 trillion in revenue, has recently announced that it will offer its sildenafil patent to several other pharmaceutical companies. "Patents are often held to be valuable assets that allow the pharmaceutical industry to advance new products with minimal change," Dr. Yohannes told The Guardian.
The sildenafil patent expires in late 2017, but it has been filed in a court case against Pfizer, which is based in Switzerland. Pfizer's patent for Viagra was granted on May 29, 2017. On Aug. 7, 2018, the European Commission granted Pfizer sildenafil patent, which will now be available by prescription only to men of that country's national population.
Viagra, which was developed by Eli Lilly and ICOS Corp., is the first oral treatment for erectile dysfunction, but the drug's patent expires in April 2020. Sildenafil will be available by prescription only to men of Japanese origin. If a man does not have Viagra, he will be able to get it by prescription.
Pfizer's Viagra has faced criticism for its lack of efficacy. A study in 2017 found that sildenafil did not improve erections in more than 2% of men. The study also noted that men who took sildenafil had lower rates of cardiovascular disease.
Eli Lilly and ICOS Corp. had earlier filed a patent infringement lawsuit against Pfizer, which had claimed the drug failed to meet the same quality control and quality control standards as the branded drug.
The lawsuit was filed in New York federal court, and Pfizer's patent expires in April 2020. A similar lawsuit was filed against Pfizer in Germany, but it was dismissed on November 2, 2019, and a third case was taken off the U. S. docket on November 11. A fourth case was taken off the U. docket on Monday.
Pfizer and Eli Lilly have been fighting for several years to get sildenafil onto the market. Last month, they won a settlement agreement with the Japanese drugmaker. It allows Pfizer to sell the drug, or any other drug, in the countries it chooses.
A Pfizer spokesperson told The Guardian on Monday that the company has not yet announced when sildenafil will become available on the market.
